Prepurchase Examination – Liability Release Agreement
I request that the aforementioned horse to be examined for purchase. Examination procedures not marked with a check are waived or declined as part of this exam. The pre-purchase examination reflects the health and soundness of the horse/pony on the day of the evaluation and is NO GUARANTEE of future soundness and suitability. We view the horse for general health, conformation and soundness for intended use on the day of the pre-purchase exam. For that exam we will do a basic health evaluation, including health history, temperature, pulse, respiration, general condition, and conformation. Lameness assessment, including flexion tests, soft tissue palpation and movement evaluation. We will also include those tests marked above.
A Purchase Examination includes a thorough physical and soundness examination performed in order to render an opinion as to the current state of a given horse and to identify those readily observable shortcomings current with the standards set by the veterinary profession.
We perform this examination only at the request of the buyer or their agent. We generally recommend that amateur owners/ non pro owners have consulted with their performance horse professional to determine suitability, talent, disposition and value prior to the examination, as such recommendations fall outside the scope of a veterinary inspection. The buyer (or their agent) is responsible for informing the veterinarian of the intended use of the horse and any known past history. The buyer (or their agent) defines the scope of the examination and requests those ancillary tests/examinations they wish our staff to provide.
A routine Pre-Purchase Exam may not reveal subtle unsoundness, especially if the horse has not been in hard/ consisitent work in the preceding months. Some conditions, such as mild recurrent airway obstruction “heaves”, mild vision impairment, early PPID “Cushing’s Disease”, digestive disorders predisposing to colic signs, and muscle disorders suce as Equine Polysaccaride Storage Myopathy “Tying Up” may not be apparent during an examination.
The purchaser acknowledges that a material condition of Bur Oak Veterinary & Podiatry Services, LLC and Dr. Dryden’s agreement to perform this pre-purchase examination is the purchaser’s agreement to release, waive, and discharge Bur Oak Veterinary & Podiatry Services, Dr. Dryden and its veterinarians and employees from all claims arising directly or indirectly from the performance of the pre-purchase examination; this is a promise by the purchaser not to sue.
The horse will not receive a “pass” or “fail” grade. We encourage the buyer and their agents, trainers and local veterinarians to discuss the findings with our veterinarian in order to gain a comprehensive understanding of the horse’s condition on the day of the exam only, as it relates to the intended use. The final decision to purchase the horse based on the information available lies solely with the buyer.
It is advisable to have all your questions regarding the examination addressed prior to the actual purchase of the horse.
Simpler examinations may not adequately provide comprehensive information about your prospective horse. We do recognize that the scope of this exam may be beyond the wishes of some pleasure horse buyers. In those cases, we encourage you to call the office so that we might better be able to meet your specific needs and desires.
